This Privacy Policy applies to all and any personal information which The Cup Club collects, holds or uses.

This Privacy Policy outlines our practices and rules concerning the handling of your personal information. We will abide by it and the Australian Privacy Principles in force under the Privacy Act 1988 (Cth). A printed copy of this Privacy Policy can be obtained by contacting our Privacy Officer (details below under heading 'Concerns or requests for access').

To use our website, you must accept our Terms and Conditions and the terms of this Privacy Policy and in so doing you consent to our collecting your personal information, including any sensitive information, for these purposes and reasonably related purposes. The definition of personal information and sensitive information is set out at the end of this Privacy Policy and where we refer to personal information in this Privacy Policy it includes sensitive information.

Why we collect Personal Information.

The Cup Club is passionate about horse racing. It is a horse ownership club that gives members access to some of the world’s best thoroughbred horse races, events and experiences.

The Cup Club’s activities include:

promotion of horse ownership and horse racing;
holding premium events;
providing members with access to trainers, jockeys and racing identities;
conducting competitions and promotions.

We collect, hold, use and disclose personal information in order to carry out the activities listed above and for other purposes which are required or authorised by or under law or for which you have provided your consent.

We may also use your information for compliance purposes and in-house research and analysis. This helps us to:

improve our understanding of customer needs;
create marketing profiles;
support strategic development; and
ensure we are complying with the regulatory and legal framework in which we operate.

To enable us to conduct research we may share your information with third party suppliers employed to help. All results of any such research and analysis will be anonymised or aggregated information and will not reveal any personal details of individuals.

How do we collect your personal information?

Where possible we collect your personal information directly from you. For example, when you joined as a member of The Cup Club, attended one of our events, entered one our competitions or sent us an enquiry we may have collected your name, email address, contact details and your responses/queries. If we have called you, we may have collected details of our conversation with you.

We may monitor (record) telephone conversations with you for staff training and compliance purposes. We will inform you prior to any telephone conversation which is monitored (recorded) in this way to obtain your prior approval.

In addition some personal information may also be collected by use of “Cookies” when you contact The Cup Club or its associated entities on-line. A cookie is a small file which is placed on your hard drive when you visit The Cup Club websites (directly or via our applications). We use information from cookies for purposes which may include:

Identifying returning users, and subscribers.
Eliminating the need for returning users to re-enter their login details.
Enabling you to move more easily around our website and applications.
Tracking your use of our sites to better develop our sites and applications in accordance with your requirements.

In doing so, and to enable us to provide you with these services, we will include your personal information in our direct marketing database and customer databases.

In order to provide those services or fulfil the purposes identified above, we may also disclose your personal information or some of it to other of our related entities or businesses or affiliated third party service providers such as data processors or direct marketing consultants.

Direct Marketing

From time to time we may use your personal information to provide you with information about our services, the services of our related entities and businesses (including G1X Pty Ltd and its Betting Partners) and affiliates and other horse racing-related opportunities. We may contact you in a variety of ways, including by mail, email, SMS, telephone or other form of electronic messaging. By accepting the Terms and Conditions on our website and the terms of this Privacy Policy and by providing The Cup Club with your information, you consent to direct marketing to you of relevant services or opportunities identified by The Cup Club, its related entities or third party service providers dealing with The Cup Club. If any phone number you have provided to us is registered on the Do Not Call register you consent to The Cup Club or its direct marketing providers calling that number or those numbers. The Cup Club may continue to contact you for an indefinite period unless and until you advise us otherwise.

If you do not want to receive any of this information, you may opt-out of receiving direct marketing at any time by contacting our Privacy Officer whose details are set out below. You may also opt-out and stop the delivery of future promotional material from The Cup Club by following the special instructions in any marketing email you may receive from us. These instructions will tell you how to remove your name from our database and marketing list.

Once you have told us you no longer wish to receive information about our services, we will not send you any further material. We will keep your basic details in our ‘do not contact’ database so that we do not contact you again.

You can, however, change your mind about receiving information about our services at any time – you just need to let us know by contacting us as outlined above.

Do we disclose your personal information to anyone?

The Cup Club will disclose your personal information to our related entities and businesses (including G1X Pty Ltd) and/or certain affiliated third party service providers in certain relevant circumstances and in the provision of our services to you. This may include disclosure to:

Third party service providers such as data processors for the purpose of entering your information into our databases.
G1X Pty Ltd and its Betting Partners and other relevant service providers such as breeders, owners and syndicators.

Finally, The Cup Club or its undertaking may be the subject of sale or negotiations for sale in which case your personal information may be disclosed and ultimately pass into the custody of a purchaser. If this occurs disclosure and transfer will be subject to the terms of this Policy and the Australian Privacy Principles.

Is my personal information secure?

The Cup Club takes all reasonable precautions to safeguard your personal information from loss, misuse, unauthorised access, modification or disclosure.

We employ a number of means to protect your personal information, including:

External and internal premises security.
Restricted access to personal information.
Maintaining a secure computer network to prevent unauthorised access.
Regular reviewing and testing of our software in order to improve the level of security and internal policies in relation to The Cup Club computer use.
Taking reasonable steps to ensure third parties provide information security of a similar standard.

Please note that there are inherent features of internet communications – including e-mail – which are not secure and may involve your communications being routed through a number of servers and different countries. The Cup Club cannot control this and does not guarantee the security of such transmission. Be aware that various encryption methods can be employed to secure that information if you are concerned about it but, once again, The Cup Club does not control or particularly recommend any of these and does not warrant their effectiveness.

Offshore recipients

The Cup Club may use the services of overseas data storage and processing services and may maintain databases outside of Australia.

The countries where your personal information may be sent may include the USA and the Philippines. The Cup Club contractually obliges all and any overseas parties to whom it entrusts its data and your personal information to abide by the terms of this Privacy Policy and provide secure and discrete information handling and storage which meets the standards required by Australian law.

As noted above, you should also be aware that e-mail services and communication over the internet may involve portions of your personal information being routed through servers located anywhere in the world. This is a technical feature of the function of the internet and e-mail and is not a matter under The Cup Club’s control.

Can I access or correct my personal information?

You may request access to any of the personal information we hold about you. In most cases, a summary of personal information such as your name and address details, contact telephone numbers and the matters you have engaged us on are freely available to you by contacting The Cup Club Privacy Policy.

The Cup Club may be required by law to retain your personal information for a period of time after you have ceased your relationship with us. After the required time has passed, we attend to the secure destruction or deletion of your personal information.

Can I complain about a breach of my privacy?

We offer a free internal complaint resolution scheme. Should you have a privacy complaint, please contact us so we can try to fix the problem.

To assist us in helping you, we ask you to follow a simple three-step process:

Gather all supporting documents about the matter of complaint, think about the questions you want answered and decide on what you want us to do.
Contact the The Cup Club Privacy Officer via the contact details outlined above, where your situation will be reviewed and if possible resolved straight away. A quick chat is all that’s required to resolve most issues.
If at this stage the matter has not been resolved to your satisfaction, the matter will be referred to a senior manager within The Cup Club. We will provide you with the name and contact details of the officer who will investigate your complaint, answer your questions and do all they can to assist you.

What if I am not satisfied with the response?

If you are not satisfied with the result of your complaint to The Cup Club, you can refer your complaint to the Office of the Australian Information Commissioner.

Changes to this Policy

The Cup Club may review and vary this Privacy Policy from time to time. Any variations will become effective upon publication of the amended Privacy Policy on The Cup Club’s website.

Definitions

“Betting Partner” means a wagering service provider with whom G1X Pty Ltd has an affiliate agreement at any given time.

“The Cup Club” is The Cup Club Pty Ltd (ACN 165 313 995) and its related entities and related businesses.

“Personal information” is any information about you that identifies you or information by which your identity can be determined.

“Sensitive Information” is personal information concerning your:

THE CUP CLUB MEMBERSHIP TERMS & CONDITIONS

The Cup Club Pty Ltd (ACN 165 313 995) of 600 Glenferrie Road, Hawthorn, VIC 3122 (The Cup Club or ‘we’, ‘our’ and ‘us’ as the context permits) welcomes you as a member and looks forward to providing you with a range of valuable membership entitlements.

While our priority is together To Win the Melbourne Cup, we’re determined to have fun and introduce you to a lot of people and new experiences along the way.

1. APPLICATION AND PAYMENT OF MEMBERSHIP FEES

1.1 Membership is activated when we accept your completed application form and when we receive your first membership payment – either a monthly payment or discounted annual payment.
1.2 Applications can be made online at www.thecupclub.com.au or simply by completing the application form and returning it by post to the attention of:

1.3 By applying to join The Cup Club you warrant and represent to us that you are 18 years of age or over.
1.4 The Cup Club membership is payable monthly in advance with your first membership fees due on application. There are no joining fees and no administration fees.
1.5 The Cup Club reserves the right to refuse membership applications in its absolute discretion and without providing reasons. If we elect not to accept your application then we will promptly and fully refund your paid membership fees.

2. MONTH-TO-MONTH MEMBERSHIP

2.1 Membership operates on a monthly basis and you are free to discontinue your membership at any time by notifying us and/or otherwise by simply discontinuing to pay your membership fee.
2.2 If you elect to discontinue your membership or otherwise do not pay your subscription by the due date then we will terminate your membership and your membership benefits will cease.
2.3 There is no requirement to enter into any long-term contract. Therefore no adverse consequences apply should you wish, for whatever reason, to cease your participation in The Cup Club.

3.0 MEMBERSHIP FEES AND DISCOUNTED ANNUAL MEMBERSHIP FEES

3.1 As at the date of publication of these terms The Cup Club’s fixed monthly fee is $50(plus GST).
3.2 If you choose to pay your membership fees annually in advance you will receive a discounted rate of 15%.
3.3 In addition to receiving the 15% discounted rate for paying your annual membership in advance, as a fully paid annual member you will be entitled to other exclusive Cup Club benefits.

4. REFUND POLICY

4.1 Other than in relation to those members who have paid membership fees annually in advance (see clause 4.2), there is no refund of any membership fees should you cancel your membership.
4.2 If you have paid your membership fees annually in advance and you elect to terminate your membership before the conclusion of your annual membership term, you will receive a part refund of your membership fees for the unexpired part of your membership term.
4.3 The amount (if any) to be refunded under clause 4.2 will be calculated from the end of the relevant membership month in which you give us written notice of your decision to terminate, through to the expiry of your unexpired membership term.
For example, if you became a fully paid-up annual member on 15 October 2013 and then subsequently terminate your membership on 1 April 2014 then we will refund membership fees for the 6-month period commencing 15 April 2014 to the end of the term (14 October 2014).
4.4 We will not refund any membership fees should we have cause to terminate your membership arising from your breach of these terms.
4.5 Changes (if any) to monthly membership fees will only be made at the beginning of each financial year. Fully paid up annual members will enjoy the benefit of fixed membership fees for their membership term.

5. MEMBERSHIP ENTITLEMENTS

5.1 The Cup Club offers a range of membership benefits, including the right to attend special ‘invitation only’ events and to share in the experience of racehorse ownership. You can always find a current list of membership services, benefits and upcoming events at www.thecupclub.com.au and follow us on various Cup Club social media accounts.
5.2 A significant membership benefit is derived from participating in The Cup Club’s part ownership of racehorses: racehorses that have been identified by their trainers as ‘stayers’ and targeted towards competing in racing events and, all going well, to ultimately qualify to race the Melbourne Cup.
5.3 Importantly, membership of The Cup Club does not entitle members to any right, title or interest in The Cup Club or in any of the racehorse ownership syndicates in which The Cup Club may invest.

6. THE CUP CLUB’S RACEHORSE INVESTMENT ACTIVITIES

6.1 Subject to available funds, The Cup Club will invest in racehorse syndicates (i.e. as a part owner) that are aligned with The Cup Club’s purpose. All racehorse investment decisions will be made at the sole discretion of The Cup Club’s then current board.

7. DISCLOSURE ABOUT YOUR MEMBERSHIP FEES

7.1 The Cup Club will apply membership fees towards the provision of the member benefits, as those benefits have been outlined in these terms.
7.2 Approximately eighty per cent of the total amount of membership fees, and any race winnings, will be applied by The Cup Club in the racehorse investment activities referred to in these terms.
7.3 The Cup Club’s operating costs are also paid from consolidated membership fees. The Cup Club will budget to apply twenty per cent of membership fees towards the following types of activities:
7.3.1 horse training and maintenance costs;
7.3.2 member event management and hosting costs;
7.3.3 marketing costs;
7.3.4 remuneration of directors for the provision of services and conducting The Cup Club’s operations in accordance with directors’ duties at law; and
7.3.5 engagement of external professional advisors (e.g. accountants and solicitors) relevant to The Cup Club’s operations.

8. LIABILITY

8.1 In relation to your membership of The Cup Club, and our provision of membership services:
8.1.1 we exclude all implied conditions and warranties, except those of which the exclusion would contravene any statute or cause any part of these terms and conditions to be void;
8.1.2 to the fullest extent permitted by law, we will not be liable for any loss or damage (whether foreseeable or not) suffered by you or any other person acting on our advice, whether the loss or damage arises in connection with our negligence, default or lack of care, any misrepresentation or any other cause; and
8.1.3 to the extent that we can not exclude our liability then our liability is limited, at our election, to either repaying to you the membership fees paid or providing the relevant services to you again.
8.2 The Cup Club will not be liable for any failure or delay in providing any membership benefits.
8.3 The Cup Club will have no liability for any loss to the extent that is caused by you (for example through your negligence or breach of contract) and you must also take reasonable steps to minimise your loss.
8.4 Subject to clause 8.1 The Cup Club and any of its officers, employees or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or connection with these terms, our services and your membership of The Cup Club. To the extent this clause refers to a person who is not a party to these terms, we hold the benefit of this clause on trust for those persons.

9. ACKNOWLEDGMENTS ABOUT HORSE RACING AND MEMBERSHIP OF THE CUP CLUB

9.1 Racehorse ownership is an inherently risky and speculative venture. The Cup Club’s focus is to provide you, our members, with a range of member benefits including the thrill of racehorse ownership – without the risks and high costs of ownership.
9.2 The Cup Club is not making financial investments on your behalf with the view of generating financial returns for members.
9.3 By joining The Cup Club you expressly acknowledge and agree that:
9.3.1 it is very unlikely that we will generate sufficient winnings to cover the total costs of providing The Cup Club benefits, including the cost of horse ownership;
9.3.2 if The Cup Club does win prize money from its racehorse ownership activities then this money will be re- invested into providing The Cup Club benefits; and
9.3.3 you are not joining with an expectation of receiving payments from The Cup Club.

10. PRIVACY

10.1 Please note that some of the information you provide to us when joining The Cup Club, and participating in The Cup Club’s activities, will be “personal information” within the meaning of the Privacy Act 1988 (Cth).
10.2 We collect and use your personal information (e.g. your name, telephone numbers and address details, including email address details) to process your application, to process direct debit payments, to provide you with membership services and to keep you informed of upcoming events.
10.3 The Cup Club will also disclose information about you to related bodies corporate, suppliers contractors and to other members in connection with the activities mentioned in clause 10.2.
10.4 If you elect not to disclose personal information, we may be restricted in the manner in which we are able to supply member benefits to you.

11. DIRECT DEBITING TERMS

11. 1 The Cup Club may offer you the ability to pay your monthly membership fee via direct debit or credit card. If you elect to pay your Cup Club membership via monthly direct debit, your membership will be continually renewed automatically until terminated.

12. FEEDBACK AND COMPLAINTS

12. 1 Your feedback and complaints are important in helping us to resolve your concerns quickly and effectively. If you have any feedback, questions or complaints about The Cup Club and/or our services, please provide us with all the relevant details in writing to:

12.2 Management of The Cup Club undertakes to respond within 10 days informing you of the course of action we will need to take as well as an approximate time frame.

13. MISCELLANEOUS

13.1 If a Court decides that any section of these terms and conditions is invalid or unenforceable then that section will be deleted from these terms and conditions. The other sections will remain valid and enforceable.
13.2 Unless we have terminated your membership – e.g. because of a breach by you of our terms – then you will always be welcome to apply to resume your membership at a time that suits you.
13.3 You agree as a condition of your membership to comply with any rules introduced by The Cup Club, including as may be varied from time to time.
13.4 The Cup Club reserves the right to change, from time-to-time, the services and benefits available to members and also, to vary these terms and conditions of membership.
13.5 Your membership of The Cup Club is not transferable – that is, you can not assign or transfer your membership to another person.

The Cup Club offers members a range of benefits including special ‘invitation only’ events and sharing in the experience of racehorse ownership.

Importantly, membership of The Cup Club does not entitle members to any right, title or interest in the Operator or in any of the racehorse ownership syndicates in which the Operator may invest.

2. MEMBERSHIP FEES

Membership fees are currently $50 (plus GST) per month. If you choose to pay your membership fees annually in advance you will receive a discounted rate of 15%. No additional expenses apply to membership. We do however reserve the right to charge a ticket price for attendance at special Cup Club events.

3. REPORTING

You will receive regular email updates from us about our horses, activities and our upcoming events. You will also be able to keep up to date about The Cup Club through our website and social media channels.

4. BENEFITS TO MEMBERS

The Cup Club offers a range of membership benefits, including the right to attend special ‘invitation only’ events and to share in the experience of racehorse ownership. You can always find a current list of membership services, benefits and upcoming events at www.thecupclub.com.au and follow us on various Cup Club social media accounts.

A significant membership benefit is derived from participating in the Operator’s part ownership of racehorses: racehorses that have been identified by their trainers as ‘stayers’ and targeted towards competing in racing events and, all going well, to ultimately qualify to race the Melbourne Cup.

5. THE CUP CLUB’S RACEHORSE INTERESTS

Subject to available funds, the Operator will invest in racehorse syndicates (i.e. as a part owner) that are aligned with The Cup Club’s purpose. All racehorse investment decisions will be made at the sole discretion of the Operator’s current board.

6. RACE WINNINGS

If The Cup Club wins prize money from our racehorse ownership activities then this money will be re-invested by the Operator into providing The Cup Club benefits. As noted below, approximately 80% of the total amount of membership fees, and any race winnings, will be applied by the Operator in the racehorse investment activities.

7. HOW WE WILL APPLY YOUR MEMBERSHIP FEES

The Cup Club’s business plan involves committing approximately 80% of membership fees towards horse ownership activities. The remaining 20% of membership fees will be applied towards the provision of member benefits and the Operator’s operating costs. Member benefits and operating expenses include:

horse training and maintenance costs
member event management and hosting costs
marketing costs including ambassador and sponsorship agreement fees
remuneration of the Operator’s directors for the provision of services and conducting operations in accordance with directors’ duties at law
engagement of external professional advisors (e.g. accountants and solicitors) by the Operator relevant to its

Membership of The Cup Club is operated on a month-to-month basis. You are free to end your membership at any time by notice to us or by simply discontinuing payment of your membership fees.

No cancellation fees or other adverse consequences apply if you elect to discontinue your membership. In fact you are always welcome to re-apply to join as a member in the future at a time that suits you. Monthly membership fees are not refundable.

If you elect to pay your membership fees annually in advance then a 15% discount will apply. Just as you are entitled to discontinue your month-to-month membership at any time and without consequence you are also entitled to terminate your annual membership upon written notice to us. A refund for the balance of your membership fees will be payable in accordance with The Cup Club’s membership terms.

9. DISPUTE RESOLUTION

Your feedback and complaints are important in helping us to resolve your concerns quickly and effectively. 10. IMPORTANT INFORMATION ABOUT HORSE RACING AND THE CUP CLUB

Before applying to joining The Cup Club, it is important that you understand the following in relation to the risks involved in horse racing and the nature of the benefits provided by The Cup Club:

horse racing is an inherently risky and speculative venture
joining The Cup Club carries little or no prospect of generating a financial return
any prize money is unlikely to cover the costs of providing benefits
any prize money actually won will be reinvested to provide benefits
the primary benefit of membership of The Cup Club is not a financial benefit or the expectation of a financial benefit
interests in The Cup Club are not, and are not intended to be, a financial product.
